Public tender ban has been lifted

The resolution for banning the legal entity of our company from bidding in the tenders of all public institutions and entities for a period of 1 (one) year has been lifted.

As we had previously made public through a Public Disclosure through the Public Disclosure Platform, in the lawsuit we had filed with a request to cancel the Resolution of the Ministry of Energy and Natural Resources to ban our Company (Doğan Şirketler Grubu Holding A.Ş.), a partner in the capacity of “co-manager” of Petrol Ofisi AŞ (new title: OMV Petrol Ofisi A.Ş.), and of eight companies, which Petrol Ofisi AŞ was partners with at the date, “from bidding in all public tenders” for a period of 1 (one) year, which had been published in the Official Gazette of 21.04.2009, following the motion for stay of the Ankara 12th Administrative Court through the Verdict of 11.11.2009, the same Court has cancelled the transaction which constituted the subject of the case, with the Verdict of 27.05.2010.

Upon the appeal procedure by the Defendant Administration, the State Council 13th Department had annulled the Verdict of the Ankara 12th Administrative Court with the Verdict of 24.03.2014. Our request to have this Verdict amended had been rejected with the Verdict of the State Council 13th Department dated 18.02.2015.

Subsequently, while a request had been placed with the Ankara 12th Administrative Court to persist in the “cancellation Verdict”, it has been learned that the remaining period of 237 days of the “Public Tender Ban Resolution” has been started to be implemented with the Verdict of the Ministry of Energy and Natural Resources published in the Official Gazette of 27.05.2015, no. 29368.

However, it has been understood that the Ankara 12th Administrative Court has deemed our request to persist in the “cancellation Verdict” affirmative, and does persist in the Verdict to cancel the resolution of banning our Company’s legal entity from bidding in public tenders. As a result of this development, the Ministry of Energy and Natural Resources has resolved, with the approval of the Minister of Energy and Natural Resources, dated 23.06.2015, no. 134, to lift the banning verdict issued for 237 days, which was the remaining period of the resolution to ban our Company (Doğan Şirketler Grubu Holding A.Ş.) from bidding in the tenders of all legal institutions and entities for 1 (one) year as per the provisions of Article 26 of the Public Tender Contracts Law No. 4735, as published in detail by the General Directorate of Elektrik Üretim A.Ş. in the Official Gazette of July 4, 2015, no. 29406.
